“According to the FHWA, states may not reference federal DBE requirements nor include the use of XBE subcontractors or subcontractors of other disadvantaged business programs as a rating factor in their procurement processes for NEVI-funded projects. In response to this direction from the Federal Highway Administration (FHWA), INDOT has made the following amendments to the NEVI program’s Notice of Funding Opportunity (NOFO) and applicable appendices:
- Removal of the scoring criteria under Part C Equity, Workforce, and Education that allowed applicants to score 10 points for inclusion of an XBE on the team.
- Reallocation of the 10 points in the initial NOFO for applicants who include an XBE on the application team to the remaining equity criteria.
- Removal of the question asking to list all XBEs on the application team from the template appendix.”
